The ideal situation occurs when there is an agreement between the spouses on their future living arrangements.
First of all, the situation of minor children, if any, must be addressed (where they will live, who will pay for their food, education, extracurricular activities, etc.).
Furthermore, it is necessary to come to an agreement on the division of any communal property, i.e. the property acquired by the spouses during their marriage (even if it is the income of only one spouse), excluding gifts or inheritances intended exclusively for one of the spouses. Caution should also be exercised with regard to any loans, credit, mortgages or other encumbrances on property.
Last but not least, any maintenance between the spouses and the future living arrangements need to be clarified.
